Product Use, Policies & Refund

1. Nature of the product (educational only)

The Simulator is an educational study and practice tool intended to help adult learners prepare for psychiatric-mental health nurse practitioner board-style examinations.

• It is not medical advice, clinical advice, nursing advice, or legal advice.
• It is not affiliated with, endorsed by, or sponsored by ANCC, AACN, or any board/certifying body unless expressly stated in writing.
• It does not guarantee exam passage, score improvement, licensure, certification, employment, or any professional outcome.
• Practice content may include sample scenarios for study purposes only and must never be used as a substitute for professional judgment, official study materials, or supervised clinical practice.

2. Eligibility & personal license

• You must be at least 18 years old and able to form a binding agreement.
• Access is sold as a personal, non-transferable, non-sublicensable license for your individual use only.
• Sharing, selling, publishing, redistributing, scraping, or reverse-engineering access codes, questions, explanations, or any Product materials is strictly prohibited.
• One payment generally entitles one purchaser to one personal access code for the stated access window (currently 30 days), unless we state otherwise in writing at the time of sale.

3. Price, payment & access delivery

• Listed prices (unless a different offer is clearly stated at checkout): Free Starter (25 questions/day); Dual Board 30 days $29.99; Dual Board 90 days $49.99; NCLEX-RN only 30 days $19.99; PMHNP-BC only 30 days $24.99.
• Payment may be accepted through Cash App or another method we designate.
• To receive your code, you must include a valid email address in the payment note (or follow the delivery instructions shown at purchase).
• Access codes are typically emailed within a few hours of confirmed payment during normal processing hours; delays may occur on weekends, holidays, or if payment details are incomplete.
• You are responsible for providing a correct email address and for checking spam/junk folders.

4. Acceptable use & account integrity

• Use the Product only for lawful, personal study purposes.
• Do not attempt to bypass paywalls, clone codes, abuse retake systems, attack the site, or interfere with other users.
• We may suspend or revoke access without refund if we reasonably believe the access code was shared, resold, obtained fraudulently, or used in violation of these policies.
• You agree not to copy exam items for public posting, group chat dumps, course piracy sites, or commercial redistribution.

5. Disclaimer of warranties (please read)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRODUCT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

• We do not warrant that the Service will be uninterrupted, error-free, virus-free, or continuously available.
• We do not warrant that content is complete, current for every exam blueprint revision, or free of typographical/clinical wording limitations.
• Your use of study results is at your own risk. Always verify critical clinical information with authoritative sources and licensed professionals.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DR. BERNIER, SITE OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, EXAM OPPORTUNITY, CAREER OUTCOME, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF THE PRODUCT.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC ACCESS PERIOD GIVING RISE TO THE CLAIM (typically the amount you paid for that plan).

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed by law.

7. Refund policy (clear & limited)

No refund is owed for any of the following:

• Buyer’s change of mind after a code is issued or used
• Failure to use the Product during the 30-day window
• Exam failure, low practice scores, or dissatisfaction with study results
• Buyer provided an incorrect/unreachable email and later cannot retrieve the code
• Device, browser, network, or local storage issues on the buyer’s side
• Sharing or loss of an issued code
• Violations of these policies resulting in revoked access

Limited courtesy review may be considered only if:

• Payment was charged more than once for the same purchase (duplicate charge), or
• We confirm we never issued a working access code after valid payment and a correct email were received, or
• We confirm a verified technical defect on our side that completely prevented access and we cannot restore access within a reasonable time.

To request a review, email info@drbernier.pro within 7 days of payment with: payment confirmation, date/time, amount paid, plan SKU (if known), Cash App / payment reference, and the email used in the payment note. Submitting a request does not guarantee a refund.

8. Privacy & communications

• We use purchaser-provided email addresses to deliver access codes and respond to support requests.
• Do not include sensitive medical patient information in payment notes or support emails.

9. Changes to the service or policies

We may update content, features, access methods, or these policies from time to time. The version posted on this page at the time of your purchase governs that purchase, unless a change is required by law.

10. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules, except where consumer-protection laws of your place of residence require otherwise.
